In the wake of Ghosn's arrest, the automaker is also planning to terminate other agreements under which it had been providing residences to Ghosn, a person with knowledge of the issue told Reuters, including the lease agreement on an apartment in Amsterdam. It also reported, citing unidentified investigation sources, that Ghosn had discussed the possibility of extending a three billion yen (S$37.5 million) loan to a business run by a Saudi acquaintance who later provided collateral for a personal investment.

His lawyers said they would apply for bail, but experts say this request is very unlikely to be granted.

One of the most recognisable foreign executives in Japan, Ghosn was led into Tokyo District Court in handcuffs and with a rope around his waist and was noticeably thinner.

The arrest and detention of Ghosn, who remains CEO and chairman of Nissan's capital alliance partner Renault SA, has sparked worldwide criticism of Japan's justice system, which effectively allows a suspect to be held indefinitely and questioned without a lawyer present.

Only embassy officials and Ghosn's lawyers are allowed to visit him.

With each allegation against Ghosn, prosecutors can seek up to 22 days of detention to investigate the claims - the period for the aggravated breach of trust allegation expired Friday.

Prosecutors on Friday slapped the 64-year-old with a formal charge of under-declaring his income by around four billion yen ($37 million) over three years from 2015.

The review was initiated after Renault chief Carlos Ghosn was sacked as head of Japan's Nissan and jailed in Tokyo on fraud charges in mid-November.

Ghosn, once the most celebrated executives in the auto industry and the anchor of Nissan's alliance with Renault, remains in custody in a Tokyo detention center since his initial arrest in late November.

On Wednesday, the Tokyo District Court rejected a request filed by Ghosn's defense counsel to end his detention following his arrest on allegations of financial misconduct.

If bail is granted, Ghosn, who is suffering from fever, according to his lawyer, would not likely be released until Tuesday given that Monday is public holiday. He was transferred to a bigger room with a Western-style bed, according to Ohtsuru.

Kelly, in contrast, was released on bail on December 25 and his lawyer said Friday he has since undergone surgery for spinal stenosis at a hospital in Ibaraki Prefecture and moved to a residence approved by the court.

Tokyo prosecutors say Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, is a flight risk.

"As I have repeatedly and recently made clear to the company, I look forward to continuing to assist Nissan in its investigations".

While the two Japanese firms quickly ousted him from leadership roles, Renault has kept him on and its board said Thursday that an ongoing audit has found no sign of fraud in the last two years.

The company said in a statement that it took the latest charge seriously and was strengthening governance.
