US government considers ban on flavored e-cigarettes over youth 'epidemic'

FDA Commissioner Scott Gottliebannounced the plan Wednesday, saying the agency is giving the manufacturers of Juul, Vuse, MarkTen, Blu, and Logic-which make up more than 97% of the United States e-cigarette market-60 days to submit their plans, USA Today reports. Big tobacco has yet to find a productive way to meaningfully compete against Juul, making the FDA's move a positive for the companies, according to Cowen analyst Vivien Azer.
"I certainly am in possession of evidence that warrants that", Gottlieb said, without disclosing the evidence.
"We're committed to the comprehensive approach to address addiction to nicotine that we announced a year ago", said FDA Commissioner Scott Gottlieb.
Most of the violations found in the undercover blitz, conducted from June through August, were for the illicit sale of Vuse, Blu, JUUL, MarkTen XL and Logic e-cigarette products, according to the FDA.
The agency may also ban sales of some flavored e-cigarette products, which Gottlieb says are particularly appealing to underage users, and consider shortening a grace period that now gives e-cigarette companies until 2022 to apply for FDA approval. The companies sell Vuse, Blu, Juul, MarkTen XL, and Logic e-cigarette brands, which account for 97 percent of US e-cigarette sales, according to FDA.

FDA had taken a slow approach to allow manufacturers to figure out how to submit products for consideration.
But Gottlieb says sales have soared, especially to teens, who can quickly become addicted to nicotine. But at the same time, we see clear signs that youth use of electronic cigarettes has reached an epidemic proportion, and we must adjust certain aspects of our comprehensive strategy to stem this clear and present danger.
"E-cigs have become an nearly ubiquitous - and risky - trend among teens", Gottlieb said in a statement.
"The disturbing and accelerating trajectory of use we're seeing in youth and the resulting path to addiction must end", Gottlieb told agency staffers and reporters. It's simply not tolerable. "This could mean requiring these brands to remove some or all of their flavored products that may be contributing to the rise in youth use from the market until they receive premarket authorization and otherwise meet all of their obligations under the law". "In closing the on-ramp to kids, we're going to have to narrow the off-ramp for adults who want to migrate off combustible tobacco and onto e-cigs".
Originally, e-cigarettes were created to help those who already smoked by providing options to get nicotine without tar and other cancer-causing chemicals.
In a release, the FDA said it's taking "historic action" against companies that it believes promotes use and addiction of their products to young vapers.
Hutsell says that he lost his mother to lung cancer after she smoked for over 30 years and that he wishes vaping was available for her back then.
Budding research on e-cigarettes also suggests that these flavors contain terpenes that may be more damaging to the lungs than other flavors are.
"Let me be clear: Everything is on the table", said Gottlieb.
