PayPal Tells Customer Her Death Is A Breach Of Contract

PayPal was informed of Mrs Durdle's death three weeks ago, receiving copies of her death certificate, her will and Mr Durdle's ID, he said.

A woman who died of cancer was written to by PayPal and told she faced possible legal action because her death breached its rules. As Motherboard reported in 2016, at least in the U.S., debt collectors have become adept at harassing recently bereaved families of the dead to put them in contact with estate administrators or even personally repay debts, even when they have no legal obligation to pay up.

Mr Durdle is raising funds through a JustGiving page to honour his late wife and "give back to the organisations that helped her through her cancer diagnosis treatment".

In the letter, PayPal said that Lindsay owed the company around £3,200 (around United States dollars $4240) with the letter continuing: "You are in breach of condition 15.4 (c) of your agreement with PayPal Credit as we have received notice that you are deceased. this breach is not capable of remedy".

But Mr Durdle became distressed as he read the letter headed: 'Important: You should read this notice carefully'.

It stated that Lindsay had an outstanding balance of £3,240.72 - or about $4,300. The letter goes on to acknowledge Lindsay is deceased, but in response to that PayPal is entitled to close her account, terminate her agreement with the payment service, and demand repaymant of the outstanding balance.

A husband who recently lost his wife has been left shocked and saddened after a letter arrived at his home that said his wife was "in breach of contract" because of her death.

"But I'm a member of the charity Widowed and Young, and I've seen first-hand in there how a letter like this or something like it can completely derail somebody".

"We are urgently looking into this matter, and are in direct contact with Mr Durdle to support him". While PayPal told him they would investigate, they also let him know that they wouldn't be informing him of their findings - because it was an "internal" matter. Hopefully the PR nightmare this is causing PayPal will ensure it never happens again.

The odd thing here is that it doesn't seem like a mistaken template or a case of misunderstanding: the letter makes it clear that PayPal knew that Ms Durdle had passed away, and yet the letter was sent anyway.
