Bishop, 30, had his Federal Bureau of Investigation badge with him when he went through security before court, and Goddard requested that Judge Fran Simonet modify an existing protection order to allow him to carry his gun both on- and off-duty.

Chase Bishop waived his right to a preliminary hearing and a judge granted an exception to a protection order so he could carry his service weapon.

Video released of the June 2 incident went viral across social media and late-night television, which allegedly shows off-duty 29-year-old Federal Bureau of Investigation agent Chase Bishop dancing at a Denver bar.

The change to Bishop's conditions for release from jail came as a result of the plea bargain Goddard and Denver District Attorney Office noted, refusing to disclose the details of the deal.

The hearing was scheduled for prosecutors to lay out the evidence against Bishop, but that was delayed after Goddard said prosecutors had offered a plea deal and Bishop needed time to consider it.

The FBI has not commented on the case, other to say it is cooperating with the Denver Police Department.

When Bishop picked up the weapon it discharged, striking a man. A cellphone video that has since gone viral on social media shows him suddenly doing a backflip and falling forward as his pistol slips out of his waistband.

The gun went off when Bishop went to retrieve it.

An off-duty Federal Bureau of Investigation agent reaches to pick up his dropped firearm while dancing. It accidentally fired and struck a fellow patron.

A lawyer for Mr Bishop told the judge that the man who was shot in the leg, Tim Reddington, 24, and his family did not object to the agent continuing to carry his gun.

"It's freakish. It's beyond weird", Reddington told ABC News last month, describing the incident.

Bishop, who lives and works in Washington, DC, was captured on video doing a backflip in front of a crowd of people at the Mile High Spirits Tasting Room when the gun fell from his waistband holster onto the floor.

The agent remains free on $1,000 bond. He was ordered to return to court on August 21.
