New York's governor is asking for a federal investigation into the conduct of immigration officials after an Ecuadorean pizza shop worker was detained while trying to make a delivery to an Army garrison in Brooklyn.
Though he has no criminal record, Villavicencio did come to the USA illegally from Ecuador in 2008.
Villavicencio will remain in the custody of U.S. Immigration and Customs Enforcement as he pursues permanent residency status.
"I just spoke with Sandra Chica & expressed my deep frustration with the federal government's assault on NY's immigrant families".
Villavicencio is a husband and a father of two who was detained while making a delivery to the Fort Hamilton Army Base in Brooklyn.
Natalia Aristizabal of Make the Road New York called Villavicencio "a man who wants nothing more than to stay with his wife and daughters".
In a letter to the ICE office in NY, the Democrat said Villavicencio's "expedited removal serves no legitimate public safety goal and the circumstances leading to his arrest and detention raise serious legal and policy concerns".
"They treated me like a criminal".
Villavicencio would also need to have only crossed the border illegally once, as multiple crossings make it nearly impossible to get a spousal green card.
Chica is an American citizen and married Villavicencio - who is from Ecuador - five years ago.
Villavicencio was granted voluntary departure by an immigration judge in March of 2010 but failed to leave the country by that July. As such, his voluntary departure order became a final order of removal and is an ICE fugitive.
The guards detained him, called ICE officers, and he was arrested. "I did not commit a crime", Villavicencio said in Spanish to PIX11 News earlier this week.
"He was a tax-payer, contributor to our community entering this base, and now he went from being in this base - that's here to protect us - to prison", Brooklyn Borough President Eric Adams said. "I'm listening", New York City Councilman Justin Brannan said.
The trouble for Villavicencio, who had been living with his family in Long Island, started because a new soldier was at the gate that day.
