Bethesda sues Warner for ripping off Fallout Shelter in its Westworld game

During that time, Bethesda has been watching with keen eyes, and has reportedly launched a lawsuit against Warner Bros, alleging that the Westworld mobile game is a "blatant rip-off" of Fallout Shelter.

In the complaint, obtained by Variety, Bethesda claimed Behaviour and Warner Bros. used its intellectual property without permission to develop a mobile game with the same or substantially similar gameplay experience.

From the lawsuit, Bethesda describes a specific bug that was found in a pre-release demo version of Fallout Shelter.

Westworld's core gameplay mechanics (which can be viewed in the trailer below) do appear very similar to those of Fallout Shelter.

Looking at trailers for the two games, there are noticeable similarities. Bethesda alleges that Behaviour recycled code from Fallout Shelter for the Westworld game. Anyone who has successfully copied their friend's homework in the third grade is surely shaking their head in furious curiosity over how such an obvious mistake could be made.

Update: Bethesda has confirmed with GameSpot that it filed suit again Warner Bros. and Behaviour in US District Court. Under the agreement, all of Behaviour's work on the game would be the owned property of Bethesda, but Behaviour would retain "access to source code, game assets, and other intellectual property" related to the development of the game.

Behaviour was hired by Bethesda in 2014 to assist with Fallout Shelter and it is here where the legal tussle begins.

"As a result of Behaviour and Warner Bros" unlawful conduct, "Westworld" is a blatant ripoff of 'Fallout Shelter" with largely superficial, cosmetic changes. Released this week and based on the TV show of the same name, "Westworld" is a "training simulator" where players must build underground maintenance and control facilities for the theme park. Bethesda further brings this action against Behaviour and Warner Bros.

Bethesda says it knows this to be evidence of Behaviour using Fallout Shelter code because. the identical problem appeared in internal versions of Fallout Shelter but was fixed before that game was released to the public.
